About Tytherleigh-West

A career built across engineering, property, construction and law

Tytherleigh-West has been established around a simple principle: clients should be able to obtain property advice from someone who understands not only buildings, but the wider engineering, contractual and legal environment in which property decisions are made.

With almost 50 years working within engineering and construction, that experience has included engineering design, major projects, project management, property portfolio management, consultancy, surveying, contract and delivery management and dispute-related work.

This breadth of experience means that a property is not considered from one narrow perspective. The building, proposed works, technical requirements, contractual position and wider implications can all be considered together.

Planning Building Work?

An early conversation can often identify issues before they develop into expensive delays or disputes.

If you are considering an extension, alteration, excavation or other work affecting a neighbouring property, we can advise on whether the Party Wall etc. Act 1996 may apply and explain what needs to happen next.

Frequently Asked Questions

Certain works involving a shared or adjoining structure, works at or close to a boundary, and some excavation works near neighbouring buildings can fall within the Party Wall etc. Act 1996. Whether the Act applies depends upon the nature and location of the proposed work. It is therefore sensible to obtain advice early rather than assume that a notice is – or is not – required.

A Party Wall Notice formally informs an Adjoining Owner of proposed work that falls within the provisions of the Party Wall etc. Act 1996. The type of notice required depends upon the proposed work. We can review the project and advise on the appropriate procedure.

A lack of consent does not necessarily mean the building work cannot proceed. Where the statutory process applies and a dispute arises under the Act, surveyor appointments may be required so that the matter can be addressed and, where appropriate, a Party Wall Award prepared.

A Schedule of Condition records the condition of relevant areas of a property before construction work begins. It typically contains written observations supported by photographs and can provide an important point of reference should questions regarding damage arise later.

Ideally, yes. Early professional advice can help establish whether the Party Wall etc. Act applies and allow sufficient time for the required procedures before construction is due to begin.

No. Tytherleigh-West also provides Dilapidation Reports, Leasehold Support, Measured Surveys, Condition Reports and Homeowner Surveys.
